Leases and Dilapidation
Chauntry Surveying Ltd can act for landlords or tenants on commercial property leases and dilapidation.
We advise on the relevant parties obligations with regard to the repairing covenants and possible dilapidation liabilities.
We recommend a survey at the commencement of the lease to include digital photographic records – this ensures any pre-conditions that may exist with the building are both documented and illustrated in full. This protects both parties and a formal lease agreement ensures everyone understands their respective obligations in regard to the premises.
Note to Landlords
Any financial settlement must only relate to actual loss incurred as a result of a tenant’s failure to comply with the lease. A building cannot be expected to be returned in new condition – only the condition dictated by the lease covenants taking into consideration the pre-lease condition survey.
Note to Tenants
It is essential to evaluate all lease covenants and obtain dilapidations advice at pre-lease stage and to have a pre-lease condition survey carried out.
